Beginning on August 30th of 2018, the California Office of Environmental Health Hazzard Assessment (OEHHA) established new labeling requirements for products that either contain, or may contain specific chemicals. For such products a warning label is mandatory. Proposition 65 stems from the Safe Drinking Water and Toxic Enforcement Act of 1986. The law requires that warnings be provided by manufacturers to identify for California residents their exposure to chemicals that have been identified by the state as being potentially harmful.
The intent of the warnings is to assist consumers in the state of California to make better informed decisions about possible exposure to a specific list of chemicals identified by Proposition 65. In total, there are over 800 chemicals on the list of either carcinogens or reproductive toxicants, including diisononyl phthalate (DINP), which is typically found in vinyl, such as used on chairs throughout the furniture industry, and Indeno[1,2,3-cd]pyrene, which is found in petroleum products, such as polyurethane. Most of the identified chemicals can be commonly found in everyday household items such as clothing, appliances, and every day cleaners, but also in cars and trucks.
We have been mandated by California law to include Proposition 65 warnings on all of our products that could contain chemicals on this list. Therefore, we have begun to place a warning label on those chairs and stools that we manufacture. The warning labels will read as follows:
WARNING: This product can expose you to chemicals, including diisonoyl phthalate (DINP), which is known to the State of California to cause cancer. Or
WARNING: This product can expose you to chemicals, including indeno (1,2,3-CD)pyrene, which is known to the State of California to cause cancer.
The majority of our seating solutions ship directly to consumers, but in instances where our distributor ships the products on our behalf, it is important for them to leave the labels on the products.
